West & Zampella Attorney: 'Numerous Damning Documents, Smoking Guns'

Kotick 'never intended to honour the contract'.

The media circus around the West & Zampella vs Activision trial continues to rumble on, with Gamespot securing an interview with their attorney, Robert M. Schwartz.

Gamespot asked Mr Schwartz what supporting evidence he would be releasing during the hearing.

We have numerous damning documents, smoking guns, and admissions from key Activision executives that show they seduced Jason and Vince into entering this contract in 2008 [the memorandum of understanding] with no intention of honoring it. They betrayed them, and they abandoned them.

Mr. Schwartz said that the recent payment of $42 million was because Activision ‘looked really bad’ and that ‘they didn’t want the jury to hold it against them.’

Bob Kotick is also in the firing line with Mr. Schwartz commenting,

He is the central guy. He made the decision to fire them more than a year before they were fired. He never intended to honor the contract.

It’s a fucking trial where a jury and/or judge weighs up evidence & makes a decision.

This PR spin that happens in America would be contempt of court anywhere else.
Suppose it will keep the fanboys buzzing, but christ… Really?

Yep. It’s a huge flaw in high profile trials in the US. How they think it’s okay to do such a thing is beyond me but then they’re happy for the general public to own guns. Lots of guns!

Really though, anyone who has played Modern Warfare won’t be allowed a seat on the jury and anyone else won’t even know what an Infinity Ward is. Though I wouldn’t be surprised if Activision calls for a mistrial (since they’ve refused to go on record about this stuff). But really, all this does is entertain those who don’t give a crap either way.

Personally, I kinda want W&Z to win, just to see what the hell happens to the CoD franchise. I know that’s mean since there’s CoD fans out there, but I’m still just really curious.

Kotick could easily be made the scapegoat here and should get exactly what he deserves.

That is a massive dick move by Acti if true. So i hope they hit them where it hurts and gain the rights to all COD games.

I can see this turning into a PR nightmare for Acti if it turns out that they’ve been pulling a lot of crap like this and could result in mass departures.
