Did you buy your original ‘fatty’ PS3 from GAME? Do you feel disgruntled that Sony have removed the option to use OtherOS in recent firmware updates? Do you feel like taking the fight to GAME and getting some money back?
Well, according to MaxConsole, that fight might well be worth fighting.
The website is alleging that although the retail giant might have intially deflected one customer’s request for a refund – “it is customer choice when it comes to accepting updates and GAME cannot be held responsible for loss of functionality” – they said, the customer’s persistance paid off.
“My PlayStation 3 no longer performs as it was advertised by you when I purchased it,” he says, citing the desire to “watch Blu-ray movies and use it as a Linux computer via the OtherOS functionality” as key buying decisions.
GAME then apparently responded with a £75 gift voucher as “full and final settlement” and without “admission of liability”. A gesture of goodwill, if you will, but here’s where it gets interesting – they allegedly asked the customer to keep quiet about the refund, saying the gift voucher is “conditional upon the terms of settlement being kept confidential by you.”
“By accepting this offer you agree not to disclose directly or indirectly to any third party the terms of this offer save for the purpose of enforcing the terms of this offer or as agreed to in advance in writing by us,” says the email, which MaxConsole claim to have.
The site also claims that GameStation are beginning to offer similar refunds with a proof of purchase.
