OtherOS Case Dismissed

A federal judge in the US has dismissed the last of the class action lawsuits against Sony. The legal cases were being conducted against the Japanese company in the wake of the OtherOS removal.

OtherOS was a system feature which allowed users to install a Linux operating system to a partition on their Sony PlayStation 3 hard disk. The function was used in one of the first security breaches suffered by the system and, earlier this year, Sony responded by forcing their customers who wish to connect to the PlayStation Network to give up OtherOS functionality.

US District Judge Richard Seeborg carried a motion to dismiss the case last Friday, saying:

The dismay and frustration at least some PS3 owners likely experienced when Sony made the decision to limit access to the PSN service to those who were willing to disable the Other OS feature on their machines was no doubt genuine and understandable. As a matter of providing customer satisfaction and building loyalty, it may have been questionable, as a legal matter, however, plaintiffs have failed to allege facts or articulate a theory on which Sony may be held liable

So, basically, the claimants (Sony’s customers) failed to give a valid reason why they had lost out due to Sony’s decision to remove the OtherOS functionality. There is scope within this ruling to amend their claim and return to legal action but it’s becoming difficult to see how consumers will be able to penetrate Sony’s legal defence that, beyond warranty, they’re under no obligation to continue to provide services.

  1. They might not have taken it away if more people used it but they didn’t. I’m all about fighting if the cause is good but this wasn’t a good cause in my opinion because if it can keep the consoles and PSN more secure then so be it

    • yeah, but it didn’t, did it?

      there’s piracy on the ps3, and the psn got hacked.

      and to quote a great captain.

      • well said GT it wasnt a major function 99% of the ps3 users weren’t interested in the function but it did hold a small gateway to the people who would want to hack and jeapordise other users safety and security.

        I just don’t get why people are moaning, if anyone want Linux that means that there abit tech savvy and know what there talking about, which means they all own pcs laptops etc so is a fight for a cause or just a fight for the sake of fighting/moaning?

  2. FTR, piracy was never enabled because of OtherOS.. It just allowed some escalation of priviledges and could’ve been patched without removing the OtherOS.

    Also, (I think I’ve said this before,but..) installing Linux on the PS3 isn’t about just running Linux, its about being able to program the Cell processor. A very useful skiill for someone who may want to get into the industry.. You may want to shout “Nerd!”, but bear in mind these people are the ones who build the games you play. If people cant cut their teeth on this stuff, how is any sort of talent going to be encouraged?

  3. makes me laugh as i stopped posting on tsa a few months ago but hazel is still arguing the same stuff as 6 months ago and then some lol really glad I’m enjoying my life and gaming rather than spending all my time online trying to fight the big bad corperations by moaning online. Each to there own i guess. Well done to Sony for winning and even bigger thanks for letting the moaners have even more to waste there precious life moaning about on online forums!superb everyones a winner

    • I really don’t understand you. Some people here are annoyed by the fact that it has now been removed for good, as it was a feature promised and a feature that many liked and was convenient for them. The way your going round throwing out personal attacks at hazel( a respected member of the TSA community) and the opinions of others is disrespectful. Now to joke about it is worse.

    • Actually origami, in fatty’s defense, Hazel was the one that started this whole affair.

      • BTW Steve as it was 6 months ago it’s not a personal attack it’s just a fact any debate or points you have with hazel is very very difficult to get in the level of a friendly discussion where each user takes into consideration what the other user has to say… it ends up a warzone…I’m not the only one and over the past few months of me not posting there has been other users in the exact same end of the stick.

      • your correct I shouldn’t of mentioned to the original poster having a debate with hazel that he hasn’t got a chance of this planet of her admitting she was wrong or his argument was right, that was an opinion of mine judging of previous debates with her, and since I’ve stopped posting many other debates with people in the same situation. I should keep my nose out as I have done for ages now.

      • I just get so wound up when I see other users try and have a discussion with her, and there the ones who get beaten down and not listened to while she seems to come across as some sort of fucking saint! every single time, for months and months user after user.         is this me starting this, i responded, and i apologise to Peter for that, but this is what he does.

        this was a passionate, but civil debate until he entered it.

        i have been too aggressive with people on occasion, i’ll admit that, my anger is something i’m working on.

        but i do not do what this guy does which is to deliberately provoke arguments, you’ve all seen him, how many times has he come into the comments and the first thing he does is to make some snide comment about another user without going anywhere near the topic at hand.

        and then if anybody calls him on it he acts the wounded party and claims to be doing it for the good of the community.
        and the first mention of the word troll is invariably his.

        i’ve seen this act too many times, both when i’ve been involved and when i’ve been a non participating bystander.

        once again, sorry Peter, if i’m going too far i apologise, but i feel this needs to be said.

  4. Well the PS3 got jailbroken without Linux/OtherOS, they may as well add it back in now.

    • so it opens the gateway of it it being hacked again with the otherOS?

      • Only if there is another very obscure OtherOS exploit. I know a bit about low level programming and seriously, Geohots hack was crazy obscure. I mean, he had to set an electric charge at the correct time through a certain point on the motherboard to effectively disable (only part) of the hypervisor. This allowed him only to map certain PS3 security measures, which then allowed him to create a non hardware, non OtherOS software hack.

        When I read about it, I half wanted to applaud him, the guy is a genuine genius, a freaking Einstein of the hacking world, and since he’s out of the game now, I don’t really expect another OtherOS hack like that. So no, I would disagree, but in a non-combative manner :P

    Still, I guess its an opportunity to bash Sony and those are not to be missed eh?
