UPDATE: Marvel Heroes Omega Has Shut Down Early

Marvel Heroes Omega has been closed with immediate effect, weeks before the previously announced shut down date of December 31st. Gazillion Entertainment laid of most of it’s staff just before Thanksgiving last week and now it appears all employees have left and Gazillion is no more.

It is with great sadness that we announce the closing of Gazillion Entertainment. As a result, we are not longer able to operate Marvel Heroes Omega until December 31 as originally planned, Instead, Marvel Heroes Omega will be sunset immediately on all platforms and will no longer be available as soon as this process is completed. The company would like to sincerely thank its fans and employees for all the support over years of development and live service.

Many fans are asking for their money back from Sony or Microsoft, however the Terms and Conditions of Marvel Heroes Omega do state that if the game is closed, neither Gazillion or any third party is liable.

Gazillion may at any time and from time to time revise, supplement, suspend, modify, or discontinue, temporarily or permanently, the System (or any part thereof) with or without notice to you, and terminate all licenses granted in these Terms of Service.

You agree that neither Gazillion nor any of its affiliates, licensors, agents, or employees is liable to you or any third party for any revision, supplement, suspension, or discontinuation of the System, and termination of any license.

UPDATE: According to Reddit, Sony are providing refunds for any purchases within the game in the last the 90 days, which seems fair as the that was way before it was announced the game was closing. Microsoft are also offering refunds but on any in-game purchases, although they do say it will take a while to sort this. PC players get no refunds because they have no one to look after them, being the Master Race has it’s downsides sometimes.

  1. Good job I got that platinum trophy done last week then.

    It looks like that was the only thing Gazillion did though, and they knew they were in trouble and weren’t going to have the license for long some time ago. And were still selling stuff anyway.

    Microsoft may be giving refunds (possibly depending on country) automatically, Sony (and Valve for the PC version) aren’t. But if Gazillion have fired everyone without paying them, the company has effectively gone tits-up anyway. If you wanted a refund, you’d have to join the list of people they owe money to, and you’d be right at the bottom of the list. MS would presumably be higher up the list and have more chance of getting some money back. So it’s not so much Sony/Valve being in the wrong, as MS doing more than they need to. (Would it be too cynical to suggest they’re not doing it because it’s the right thing to do, but because it makes them look good?)

    It’s all a shame, because it was a fun game, but they got a new CEO who was allegedly very dodgy (allegations of sexual harassment) and the console versions may have been a plan to make as much money as possible in 6 months before it all went wrong.

    • It’s been out for less time on Xbox, so people have more reason for a refund. Which Microsoft are giving without any fuss from what I’ve read elsewhere. Sony are always awkward fuckers when it comes to giving refunds.

      • The open beta appeared on the PS4 about a month or so before the XBox and non-beta PS4 versions were released.

        You can’t really blame Sony for not giving refunds though. They’d have to refund the money and then try and get it back from whatever’s left of Gazillion. They’d probably be slightly higher up the list than normal people, but I doubt they’d get much money back.

        Of course, the MS way is (as always) to throw money at it and try and solve the “problem” that way.

        It looks like Sony might be doing some refunds, if you’ve bought anything recently. And possibly if it looks like you’re not taking the piss. (Past refunds and the like)
